Extraordinary Drivers Licence, Section 76 of the Road Traffic Act (1974)

You may be able to apply to the court for an extraordinary driver's licence if you have been disqualified from driving.

People are usually disqualified from driving because they have accumulated demerit points, or committed some other traffic offence.

An extraordinary driver's licence may be granted if you can show that you or your family would suffer hardship and inconvenience if a licence was not granted, for example, you are unable to get to work by other means and you would probably lose your job

The holder of an extraordinary licence may be allowed to drive for a specific purpose, usually at specific times.

You cannot apply for an extraordinary licence if:

  • you have been disqualified because of a mental or physical disability, or addiction to drugs or alcohol.
  • Your licence has been suspended because you have not paid a fine or infringement notice.
  • There are waiting periods of between 21 days and 4 months before you can apply for an extraordinary licence (the length of time will depend on the seriousness of the offence).

The waiting period starts from the date you are disqualified. (Not the date of the offence).

When considering your application the court will take into account:

  • The reason for your disqualification.
  • Your behaviour since your disqualification.
  • Whether public safety would be at risk.
  • What hardship you may face.
  • Your general character.
  • The circumstances of the case.

IF YOUR APPLICATION IS REFUSED YOU WILL HAVE TO WAIT 6 MONTHS BEFORE YOU CAN APPLY AGAIN.
